Terms of Service

1. Agreement to these terms

These Terms of Service (Terms) are a binding agreement between you and Serenium LLP (Serenium, we, us), which operates the Essay+ and A+ Learning brands, governing your use of Essay+ (the Service).

By creating an account or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy.

2. Eligibility and minors

You must be able to form a binding contract to use the Service. Our approach by age:

• Under 13. An account must be created by, or with the verifiable consent of, a parent, legal guardian, or an authorised school. That adult agrees to these Terms on the child's behalf and is responsible for the child's use.
• 13 to 17. You may create an account, but your parent or guardian must be informed of that account. If you are in this band and are using Essay+ through a school or via a parent-managed account, the adult remains responsible for ensuring use is appropriate.
• 18 and over. Standard account terms apply.

We may decline or restrict access where the required consent has not been given or where we cannot verify it.

3. What Essay+ is, and is not

Essay+ provides feedback and guidance on writing you create yourself: evaluation against rubric dimensions, identification of strengths and areas to improve, ranked suggestions for your next draft, and progress tracking across revisions.

Essay+ does not write essays for you. It does not generate replacement paragraphs or text intended for submission as your own, and it is not a tool for plagiarism or academic dishonesty. The writing on the page remains yours.

4. Academic integrity

Essay+ is a learning aid. You are responsible for complying with the academic-integrity, honour-code, and AI-use policies of your school, university, examination board, or any institution to which you submit work. Different institutions treat the use of writing-feedback tools differently; it is your responsibility to know and follow the rules that apply to you. We provide guidance on your own writing; we do not authorise or endorse any use of the Service that violates those rules.

5. Your account

You agree to provide accurate information (including your role as a student, parent, or teacher), keep your login credentials secure, and not share your account. You are responsible for all activity under your account. Tell us promptly at support@essayplus.pro if you suspect unauthorised use. Parent and teacher accounts that manage linked student profiles must have appropriate authority and consent to do so.

6. Acceptable use

You agree not to:

• submit content you do not have the right to submit, or pass off someone else's work as your own to deceive;
• use the Service for any unlawful purpose or to upload unlawful, harmful, or infringing content;
• attempt to access another user's account or data;
• copy, scrape, reverse-engineer, resell, or build a competing product from the Service or its outputs, except as permitted by applicable law;
• interfere with, overload, or circumvent the security, rate limits, or integrity of the Service; or
• misuse referrals, coupons, or free trials, including by creating fraudulent or duplicate accounts.

We may suspend or terminate access for breach of this section.

7. Your content and the licence you give us

You own the writing you submit. We do not claim ownership of your essays or drafts.

To operate the Service, you grant us a limited, non-exclusive licence to store, process, display back to you, run through OCR and AI evaluation, and generate reports, comparisons, and shareable artefacts from your content - solely to provide and support the Service for you. We do not publish your work publicly, and we do not use it to train general-purpose AI models (see our Privacy Policy). This licence ends when you delete the content or close your account, except for copies we must retain for legal or security reasons or that exist in routine backups for a limited period.

8. AI-generated feedback - important disclaimer

Feedback, scores, and suggestions are generated with the assistance of automated and AI systems and may contain errors, omissions, or misjudgements. They are guidance to help you improve your own writing, not a guarantee of any outcome.

We do not guarantee any grade, mark, test score, admission, scholarship, or other result. Essay+ does not provide professional, academic, legal, or admissions advice, and feedback should not be relied on as such. Final decisions about your writing are always yours.

9. Plans, billing, and payments

Note: our plan structure is being revised. This section is kept general and will be aligned with the specifics once the new model is finalised.

The Service offers free and paid plans. Paid plans are billed through our payment processor, Stripe, on the cycle shown at checkout.

• Auto-renewal. Paid subscriptions renew automatically at the end of each billing term unless cancelled before renewal. You can cancel at any time from your account settings; cancellation takes effect at the end of the current term.
• Price changes. We may change prices with reasonable advance notice; changes apply to subsequent billing terms.
• Refunds. If you request a refund within five days of a charge, we will refund the unused portion of that charge. Refund requests outside that window are considered at our discretion. Nothing here limits any statutory refund rights you have under applicable consumer-protection law.
• Taxes. Prices are inclusive or exclusive of applicable taxes as indicated at checkout.
• Coupons and trials. Promotional offers are subject to their stated terms and may be withdrawn at any time.

10. Our intellectual property

The Service, including the Essay+ and A+ Learning names, logos, software, rubric framework, designs, and content (excluding your content), is owned by us or our licensors and protected by intellectual-property laws. We grant you a personal, non-transferable right to use the Service in accordance with these Terms; nothing here transfers ownership to you.

11. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or its users. On termination, your right to use the Service ends. Sections that by their nature should survive termination - including the content-licence wind-down, AI disclaimers, liability limits, and governing law - will continue to apply.

12. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by applicable law. We do not warrant that the Service will be uninterrupted or error-free, or that feedback will be accurate or suitable for any particular purpose.

13. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, opportunity, grades, or admission outcomes. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD 50. Nothing in these Terms excludes liability that cannot be excluded by law, including, for consumers, your statutory rights.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Service.

15. Governing law and disputes

These Terms are governed by the laws of India. The courts of Pune, Maharashtra have non-exclusive jurisdiction over any dispute arising from them, subject to any mandatory consumer-protection rights you have in the place where you live.

16. Changes to these terms

We may update these Terms from time to time. We will post the updated version here with a new “Last updated” date and, where the change is material, give you reasonable notice. Continued use of the Service after updated Terms take effect constitutes acceptance of those Terms.
